Guest Agreement
RECITALS
This property is managed by Vacatella Luxury Vacation Rentals, LLC. (“Vacatella”) is a company specializing in estate management and short-term rental bookings providing services on behalf of Majestic Investment Group LLC.
This Agreement shall not become binding until the Owner has received the total rental fee and incidental deposit from the Guest.
Reservation

Early check-in and late check-out times can be accommodated for an additional fee (if available).
Incidental Deposit to be used in the case any damage is to be found caused by Guest in any capacity, for fines if house rules have been broken or if there are additional charges for cleaning beyond the $1500 cleaning fee. Your security deposit will be refunded back to you typically within 72 hours of your check out time in the event there is no damage. If damage is found, there will be a hold on the estimated amount to repair/replace any missing or damaged items and the balance will be refunded back to you while the claim for the damage goes through the Safely Stay damage policy claim procedure. In the event the damage policy covers the total amount of the claim, the total balance will be issued back to you.
Use of the Property:
Guest may not use the Property for any purpose other than that of a PRIVATE RESIDENTIAL STAY by the Guest and up to 15 other overnight Guests (16 total). Inclusive of the overnight Guests, the maximum number of people allowed at the Property shall not exceed 25 people. Additional overnight Guests may result in loss of security deposit and immediate cancellation of the remainder of your stay and will result in a $1500 per person fine.
The Owner reserves the right to terminate this agreement and retain any prepaid rental nights security deposit which have been paid by Guest if the number of people at the Property exceeds the limits provided for herein or if the Police are called to the Property for excessive noise (due to an unauthorized Party or Event).
The Guest shall not sublet or assign the Agreement.
- LIMITATION OF 25 GUESTS ALLOWED AT ANY PROPERTY AT ANY TIME. 100% ADHERENCE TO THIS RULE MUST BE FOLLOWED AND ANY VIOLATIONS WILL RESULT IN IMMEDIATE REMOVAL OF THE PROPERTY AND FORFEITURE OF SECURITY DEPOSIT AND ANY REMAINING RENTAL FEES.

Incidental Deposit:
Guest is required to pay a $10,000 incidental deposit due 48 hours before check-in.
The Incidental Deposit paid by Guest is intended to secure payment for any missing items, damages not covered by the Airbnb AirCover policy (if applicable), penalty charges resulting from violations of house rules (including but not limited to excessive occupancy or noise disturbances), and any incidental services requested by Guest before or during occupancy of the Property.
Charges that may be deducted from the Incidental Deposit include, but are not limited to:
Property damage;
Theft, loss, or removal of household items, furnishings, or equipment;
Excessive soiling, staining, or damage to linens or furnishings;
Excessive post-occupancy cleaning beyond normal wear and use; and
Payment for incidental services or additional charges incurred during or after the stay.
The Incidental Deposit shall be returned to Guest within five (5) business days following Guest’s departure, provided no deductions are required. However, if material damage to the Property, its furnishings, finishes, or equipment is identified, return of the Incidental Deposit may be delayed while Owner conducts a damage inspection, obtains repair or replacement estimates, secures contractor bids, orders required materials or replacement items, and completes necessary repairs or replacements. Such delay may extend to thirty (30) or more business days.
If the final cost of repair or replacement is less than the Incidental Deposit amount, Owner shall retain only the amount necessary to cover such costs and shall refund any remaining balance promptly to Guest after completion of repairs and final accounting.
If, for any reason other than neglect, default, or breach by Owner, Guest refuses or is unable to use the Property in accordance with this Agreement, the full rental fee shall be retained by Owner.
The Owner's Responsibilities:
You hereby release and agree to hold the Property Owner, their officers, directors, employees, representatives harmless from and against all liability and responsibility whatsoever, for any damage to property, personal injury or loss of life which may occur to you or your guests as a result of your use of the Property and its amenities, and you do hereby agree to indemnify the Owner from and against any costs, judgments, claims or demands, including reasonable legal fees as a result of any third party actions arising from you and your guests' use of the Property and its amenities including swimming pool. The Owner does not accept any responsibility for the actions of the Guest or others in the Guest’s party or given access to the Property by the Guest or for any consequences due to their actions. You and your guests are responsible for securing your own personal property, including jewelry and other valuables, as well as the Property, which includes locking all windows and doors while away.
Security, Tidiness and Damage:
Guest shall leave the home in substantially the same condition of cleanliness as when they took occupancy. Maid service, during Guest’s stay at the Property, can be arranged at an additional charge if requested by Guest. Guest and those in Guest’s party shall respect and ensure that the Property and all furniture, fixtures and effects are maintained in good order and condition and shall promptly inform the Owner, or the Owner's staff, of any damage caused to the Property or its contents during the period of occupancy by the Guest. The Guest shall incur all charges for any such damage, for any missing items and for any excessive post-occupancy cleaning necessitated by Guest’s negligence of the Property.

HOUSE RULES
The maximum total occupancy for overnight guests is 16 people. You may have up to 8 additional visitors during the day. This property is permitted for a maximum of 25 people at the property at any given time. For additional visitors, the host reserves the right to deduct an additional $1500 per person per day from your incidental deposit.
NO INDOOR SMOKING or RECREATIONAL DRUG USE of any kind is allowed on the property. Smoking inside the property will automatically result in a $5000 fee.
NO PETS are allowed on the property.
NO PARTIES or EVENTS are allowed during short-term residential rental. Events and private parties on this property must be contracted for under separate agreement.
Guest understands that child safety fencing is not provided in the Property and Guest expressly accepts full responsibility related thereto.
Guests shall be responsible and liable for the safety and acts of all Guests and others during the term of this agreement.
Guests shall not play excessively loud music outdoors after 10pm. Any complaints in this regard, by neighbors, which are not promptly corrected, will result in the termination of this Agreement and the forfeiture of any prepaid rent and security deposit.
Owner (or its cleaners, caretakers, or designated repair persons) may enter the Property at any time to make repairs and inspections.
Guests shall cook only in areas of the Property specifically designated for cooking.
Furniture may not be moved and will result in a $1500 furniture relocation fee.
Owner reserves the right to remove the Guest, without delay, (and any persons and others in their party) who cause damage to the Property (including furnishings and other personal property on the Property) or who violate the law or act contrary to any of the conditions in this Agreement.
Repairs:
Guest will provide Vacatella prompt notice of any needed repairs and/or maintenance at the Property. Vacatella will provide a response within 2 hours of the notification between the hours of 8am-8pm and good faith repairs shall be started no more than 12 hours thereafter.
Governing Laws:
In the event that any dispute and/or difference should arise between the Guest and the Owner (which cannot be resolved speedily and amicably among the parties), the matter(s) in question shall be resolved by arbitration in the State of Nevada, United States of America.
No amendments to or deletions from the terms herein shall be valid unless accepted and confirmed in writing by both Guest and Owner. This Agreement supersedes any prior, written or verbal, understanding.
The person signing this Agreement represents that they are authorized to do so on behalf of themselves and every person in Guest’s party and such signature shall constitute acceptance of the following booking conditions on behalf of the Guest and every person in the Guest’s party who will be given access to the Property by the Guest.
If this Agreement meets with your approval, please indicate your acceptance of the above by signing where indicated below and returning this Agreement and the original to the Vacatella.
